Terms & Conditions of Hire
Melbourne Light Rentals

DEFINITIONS
(a) The “Owner” is Melbourne Light Rentals.
(b) The “Hirer” refers to the person, firm or corporation hiring equipment from the Owner
(c) The “Equipment” means all the equipment and accessories supplied to the Hirer
(d) “Terms” means these Terms and Conditions of Hire

CONDITIONS OF HIRE
(a) The hiring of the equipment will commence from the commencement date specified on your invoice and continue for the term specified. The hirer is entitled to use the equipment for the hire period. Any extension of the period must be agreed to by Melbourne Light Rentals.
(b) The hirer shall not remove the Hire equipment or any part thereof from the situation and position of its installation without consent from the owner.
(c) The hirer acknowledges that he/she has received adequate instruction on the correct use of the equipment, which includes demonstration or verbal instructions.
(d) The hirer agrees not to use the equipment at locations or purposes different to the equipment’s general designated purpose and specified suitability (such as indoor versus outdoor use).
(e) The hirer acknowledges responsibility for the equipment and is liable for any damage.

PAYMENT
(a) The hirer agrees to pay Melbourne Light Rentals the hire fee specified for the equipment for the hire period including any applicable penalties, levies or freight and/or other charges relevant to this agreement.
(b) The required fees must be paid to Melbourne Light Rentals one week prior to the commencement date of the hire period or the booking may be cancelled.
(c) Equipment not returned on time and in accordance with this agreement will be subject to a continuance of the agreed rental until return is complete.
(d) Payment for hire of goods must be made by; (i) 20% of the agreed hire price upon confirmation of order; and (ii) the balance of the agreed hire price made at least 7 days prior to delivery of the goods. Payment must be made by credit card, bank transfer or cash.
(e) The Owner requires personal and or security details at the time of order placement. An order will not be confirmed until a Booking Form is endorsed and supplied to the Owner.
(f) All orders placed less than 7 days from delivery require full payment to confirm the booking.
(g) All prices on the Melbourne Light Rentals website are in Australian Dollars (AUD).
(h) All custom built or special purchase equipment requires full payment at point of booking in order to commence manufacture or buying process.

CANCELLATION
The Hirer may cancel an order but may forfeit any hire fees paid as follows:
(a) If booking is cancelled 28 days or more before the event date, Melbourne Light Rentals. will make a full refund of any hire fees paid minus the 20% deposit paid;
(b) Bookings cancelled or item quantities reduced 27 days or less before the event date will forfeit between 50% and 100% of the total hire fee depending on the time of year. Credit may be offered to the hirer if the owner feels it’s appropriate which will be valid for 6 months from the original hire date.
(c) Bookings cancelled or item quantities reduced within 7 days of the event date will forfeit 100% of the total hire fee.

DELIVERY & COLLECTION

The goods shall be returned in a reasonably clean, but not necessarily sterile state or a cleaning fee may apply.
(b) The Hirer must allow any of Melbourne Light Rentals representatives access to the goods at all reasonable times.
(c) The Hirer must provide safe and proper access to and at the event site.
(d) The Hirer is liable for all injury, loss or damage suffered by Melbourne Light Rentals, its employees or agents while at the event site.
(e) Prices quoted are for delivery on street level. Extra charges may be applicable for delivery to and removal from higher or lower levels or for difficult terrain.
(f) The Hirer is responsible for ensuring that the House / Venue / Event Space Management have approved and are fully aware of the products and services that the Hirer would like Melbourne Light Rentals Agents to carry out.
(G) Melbourne Light Rentals Agents will not carry out any work if the Venue Management or Melbourne Light Rentals Representatives express any OH&S concerns, the Hirer will not receive a refund weather the work is complete or not.
(H) Melbourne Light Rentals Representatives will stop work Immediately if asked to do so by Venue Agents, the Hirer will not receive a refund weather the work is complete or not.
(I) If Melbourne Light Rentals Agents are stopped by Venue Agents from carrying out the delivery, install or pick up of good and services, Melbourne Light Rentals Agents will collect all lighting equipment and leave site. the Hirer will not receive a refund weather the work is complete or not.
1. SECURITY BOND
(i)The Hirer is responsible for retuning all of the hired equipment to the location that the equipment was collected from by the Hirer. The equipment is due back before 12pm the day after the hire.
A Melbourne Light Rentals Representative may change the date and time that the equipment needs to be returned via text message, email or any other written form.
If all of the hired items have not been returned the specified date and time, the full security bond will be withheld by Melbourne Light Rentals. The security bond will not be returned to the hirer.
(ii) The Security Bond will not re returned to the customer if there are dints, scratched or any other damage to the equipment.

DAMAGE

The Hirer is responsible for the equipment from the time of delivery until collection by the Owner and shall pay for all equipment damage or loss however caused during that period.
(i) Damage resulting from overloading, exceeding rated capacity, misuse, abuse or improper servicing of equipment;
(ii) Damage due to mysterious disappearance of the equipment;
(iii) Damage caused by the use or operation of equipment in contravention of any of the conditions of the agreement;
(iv) Damage to, or loss of, the equipment from any unknown cause.
(b) The Hirer shall protect the equipment from the elements during the time of delivery, use, storage or waiting period before pick-up.
(c) The Hirer shall maintain at its expense liability, property and casualty insurance coverage in amount necessary to fully protect the Owner and its equipment against all claims, loss or damage of whatever nature or type.
(d) The Owner shall not be liable for any loss or damage caused to any person, property, animal or things whatsoever arising from the use of the equipment hereby hired and the Hirer indemnifies the Owner in respect to any claims for such loss or damage.
(e) Where the Hirer is more than one person liability shall be joint.
(f) By making a booking through either submitting a booking form, deposit/payment or remittance of funds, the hirer acknowledges and agrees to the Owners Terms and Conditions.
(g) In the case of the equipment being damaged, the hirer may have the opportunity to purchase the damaged equipment.

(h) Melbourne Light Rentals will not be held responsible for any damage caused by Adhesive Hooks, the Hirer Acknowledges that Adhesive Hooks can fail due do wall / roof paint, temperature and any others reasons.
LOST/STOLEN/MISPLACED
The Hirer is responsible for the cost of replacing any lost, stolen or misplaced equipment. The hirer responsibility starts when equipment is collected from a Melbourne Light Rentals representative, or if the equipment is delivered/delivered and installed by Melbourne Light Rentals, the hirer will be responsible as soon as the Melbourne Light representative leaves the site or completes the set up.

The hirer is responsible for full cost of the equipment, including the full purchase price of the new item, shipping, tax, test and tag, and collection of the brand new piece/pieces of equipment, and any other associated cost.

Melbourne Light Rentals will determine the reasonable costs associated with replacing the item/items.
​
The Hirer will have three days to find/recover the equipment.
​
The Hirer will be responsible for the cost of any missed hires between the time the item/items were misplaced to the time where the new item/items have been received and are ready to hire.
